Article 1 – Definitions

In these general terms and conditions, the following terms shall have the meanings set out below:

Entrepreneur: HVK SERVICES LLC, trading as By Marlowe, offering products to consumers at a distance.
Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession, and who enters into a distance contract with the entrepreneur.
Distance contract: a contract concluded between the entrepreneur and the consumer within the framework of a system organized for the distance sale of products, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.
Withdrawal period: the period within which the consumer may exercise their right of withdrawal.
Business day: Monday through Friday, excluding public holidays and weekends.

Article 3 – Scope

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer. Before the distance contract is concluded, these terms are made available to the consumer. By placing an order, the consumer accepts these terms and conditions. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Article 4 – The offer

All offers on the website are without obligation and remain valid only while stated and while stock lasts. Product descriptions, images and specifications are provided as accurately as possible. Minor variations in color or appearance due to display settings do not constitute grounds for a claim. Obvious errors or mistakes in the offer do not bind the entrepreneur. All prices are stated in USD and include applicable taxes unless otherwise indicated.

Article 5 – Conclusion of the contract

The contract is concluded at the moment the consumer accepts the offer and satisfies the associated conditions by completing the online order. The entrepreneur will promptly confirm receipt of the order by email. Until receipt of this confirmation is acknowledged, the consumer may dissolve the contract. The entrepreneur reserves the right to refuse an order or attach conditions to it, stating reasons where required.

Article 6 – Right of withdrawal

The consumer may cancel a purchase during a cooling-off period of 14 days without giving any reason. This period begins on the day after the consumer, or a third party designated by the consumer, has received the product. To exercise the right of withdrawal, the consumer must notify the entrepreneur by email at info@by-marlowe.com within the withdrawal period.

During the withdrawal period the consumer shall handle the product and packaging with care and only unpack or use the product to the extent necessary to assess its nature, characteristics and functioning. Products must be returned in their original condition and packaging where reasonably possible. The consumer bears the direct cost of returning the product unless otherwise agreed.

Article 7 – Refund in case of withdrawal

Upon valid withdrawal, the entrepreneur will reimburse all payments received from the consumer without undue delay and no later than 14 days after being informed of the withdrawal. The entrepreneur may withhold reimbursement until the returned goods have been received, or until the consumer has provided proof of return, whichever is earlier. Refunds are issued using the same means of payment used for the original transaction, at no additional cost to the consumer.

Article 8 – Customs, import duties and VAT

All prices are displayed in USD. Orders are shipped to destinations within the United States, and applicable sales tax is handled in accordance with U.S. law. Where an order is dispatched to a destination that may attract additional customs charges, import duties or local taxes, these are the responsibility of the consumer and are not included in the product price or shipping cost.

Article 9 – Conformity and warranty

The entrepreneur warrants that the products conform to the contract, to the specifications stated in the offer, and to reasonable requirements of soundness and usability. Nothing in these terms limits the statutory consumer rights and remedies available under applicable United States and state consumer-protection law. Where a product proves defective or non-conforming, the consumer should contact the entrepreneur promptly so that an appropriate remedy can be arranged.

Article 10 – Delivery

The entrepreneur exercises the greatest possible care when receiving and executing orders. Orders placed before 3:00 PM ET begin processing the same day. The processing time is 1 to 2 business days (Monday to Friday, excluding weekends), after which delivery takes 5 to 10 business days (Monday to Friday, excluding weekends). Delivery is free on all orders.

Delivery times are indicative and do not constitute strict deadlines. The risk of loss or damage to the products passes to the consumer at the moment of delivery to the consumer or a representative designated in advance.

Article 11 – Complaints

Complaints regarding the performance of the contract must be submitted to the entrepreneur by email, fully and clearly described, within a reasonable time after the consumer has discovered the defect. The entrepreneur will respond to complaints within 14 days of receipt. If a complaint requires a longer processing time, the entrepreneur will confirm receipt within this period and indicate when a more detailed response can be expected.

Article 12 – Disputes and applicable law

Contracts between the entrepreneur and the consumer to which these terms apply are governed exclusively by the laws of the State of Delaware and the applicable federal laws of the United States, without prejudice to the mandatory consumer-protection rights the consumer enjoys under the law of their place of residence. Any disputes will, where possible, first be resolved amicably through direct contact with the entrepreneur before being submitted to the competent court.
